In so remarking, Wells implicitly acknowledges the inherent inadequacy of the law when it comes to asking difficult questions about itself. Thus, we see a flicker of radical feminism. The criminal justice system rests on fictitious assumptions regarding its own presumed infallibility; it is resistant to external questions such as those asked by Wells. One therefore has to look to other systems of norms, such as morality, to get to the root of questions such as why the criminal justice system failed Clark and Cannings so badly. Wells contends that ‘Feminist arguments are crucial in beginning to unravel these questions.’[5] In particular, she argues that the social construct of women as nurturers feeds into our ideas of what is unwomanly; with what is bad. She quotes Oakley, who remarks that ‘Of all the things women are supposed to be, mothers come first.’[6] The argument is that the legal system, being implicitly male, reinforced and implemented these essentially stereotypical images of women; in the case of Clark and Cannings, it imposed an essential male system of morality onto them, with the result that two completely innocent women were convicted.In addition, Wells argues that the ‘increased medicalisation and institutionalisation of reproduction and infant development’[7] has further bolstered the social stereotype of the good mother. This in turn affects the law, which as a system is receptive to systems of standards such as medicine because of their professed objectivity (and therefore masculinity, as many feminists would argue). Thus, legal developments from the Infanticide Act 1623 to the rise of ‘compulsory motherhood’ have reinforced medical and patriarchal views of what women ought to be.[8] The latter idea denotes a group of behaviours which are deemed appropriate to good motherhood, and into which women are expected to enter.
