The role of the mediator is to facilitate negotiations between the parties. As such, negotiation and mediation intersect since negotiation is a fundamental component of mediation. However, the mediator cannot impose a result on the parties and is not duty bound to express a view about proceedings in any case (publicly or privately). In the same way that parties may withdraw form negotiations, parties are entitled to withdraw from mediation proceedings at any time. In general, the mediators’ principal functions involve managing the mediation process, gathering evidence, the collation of evidence; providing an overview of the salient issues of importance to both parties; allowing for both parties to express themselves in a controlled situation; helping the parties to overcome obstacles/barriers to a successful resolution; the communication of offers/counter-offers to both parties in an impartial way; providing problem-solving assistance in helping both parties to reach specific commercial objectives; helping to shape and to maintain a positive atmosphere in which resolution of the dispute is viewed as an achievable objective; and finally, the mediator is also involved in assisting the formal drawing up of any agreement reached, alongside the parties’ legal representatives.
